Terms of service
These terms govern your use of eFlow, available at app.eflow.company. Creating an account means you accept what is written here. If you do not accept it, do not use the service.

Who we are
eFlow is operated by [COMPANY LEGAL NAME], a company incorporated under Brazilian law, with its seat at [ADDRESS], Rio de Janeiro, Brazil, registered with the CNPJ under number [CNPJ] and with municipal registration number [MUNICIPAL REGISTRATION], with share capital of [SHARE CAPITAL]. What eFlow is
eFlow is software as a service that turns photographs of real estate into marketing media, using artificial intelligence models operated by third parties. It includes video generation from photographs, photo enhancement, text to image, a template-based design studio, a video editor and a conversational assistant. It is built for real estate professionals: agents, agencies, architects and property developers. Output is generated automatically. This is not a production service with a human in the loop, and we do not guarantee a specific result for a specific instruction.
Definitions
Service: the eFlow application and every product reachable through it. Account: the individual registration through which you access the Service. Customer content: the photographs, text and instructions you upload or write. Output: the image, video or text file the Service produces from Customer content. Credits: the internal unit of consumption each operation is paid with. Model vendor: the third party that runs the generation, named in the Privacy policy.
Account, eligibility and security
You must be at least 18 and able to enter into contracts. You are responsible for everything that happens on your account and for keeping your password secret. The details you register must be true and current. We may suspend accounts with false details or shared with third parties outside your control. Your email address must be verified through the link we send at registration. Verification is what releases the free welcome credits; until you do it the account still works with whatever credits it already has. When a sign-in comes from a network the account has never used, we ask for an approval by email before issuing the session. It is a security measure and does not replace your own duty to protect your credentials.
Credits, plans and payment
Usage is paid in credits. It is credits, not the plan, that give access to the products: an account with no paid plan can use every product that is switched on, as long as it has a balance. Each account receives once, and only once, a batch of free credits after verifying its email address. Credits do not expire while the account exists. The pricing model is an auto-renewing subscription, charged in advance for the contracted period, to which you can add one-off credit top-ups. Prices are shown in euro and include VAT at the rate applicable in your country of residence. Payments are processed by Stripe. This application never receives or stores card details. The invoice or receipt issued by Stripe is your proof of purchase. The applicable price and the number of credits for each operation are the ones shown at the moment of purchase or generation.
Right of withdrawal (14 days)
As a consumer resident in the European Union you have the right to withdraw from the contract within 14 calendar days of entering into it, without giving a reason, under Portuguese Decree-Law 24/2014 of 14 February and the corresponding national law where you live. eFlow is digital content supplied without a tangible medium. By requesting immediate performance (generating content or spending credits) and acknowledging that request, you lose the right of withdrawal for the part already performed, under article 17(3) of that Decree-Law. The unconsumed part remains refundable within the 14 days. The procedure is described in the Refund policy.
Content, rights and licences
You keep ownership of the photographs and text you upload. You warrant that you hold the necessary rights over that material, including permission from identifiable people shown in it and from the rights holders of the properties photographed. You grant us a non-exclusive licence, limited to running the service, to store and process that material, including sending it to the AI model vendors strictly to produce your output. This means your photographs leave our infrastructure and are transmitted to those vendors. Who they are and what they receive is set out in the Privacy policy. We do not use your content to train models of our own, and we do not permit vendors to use it to train theirs. The generated output is yours to use commercially, to the extent applicable law and the model vendors’ terms allow. AI-generated content may not be protectable by copyright in some jurisdictions.
Acceptable use
You may not use eFlow to generate content that is illegal, defamatory, misleading about the real characteristics of a property, sexually explicit, discriminatory, or that infringes the rights of others. The depiction of a property must not mislead a buyer or tenant about its condition, size, location or fittings. Publishing the output is your responsibility. You may not upload photographs of people without a legal basis to do so, attempt to bypass technical limits, resell access, extract the models, or automate usage in a way that degrades the service for others.
Third-party services
The Service depends on third parties for payments, hosting, email delivery and content generation. They are named in the Privacy policy. A failure, change or outage at those third parties can affect the Service. We answer for the selection and supervision of our processors, not for the internal workings of their systems. If you use Google sign-in, authentication is performed by Google under its own terms.
Data protection
How we process your personal data is described in the Privacy policy, which forms part of these terms. When you upload photographs showing identifiable people, you are the controller of that data towards those people and we act on your behalf for that part. You must make sure you have a legal basis to do it.
Liability
The service is provided as is. We do not warrant that it is error-free or that the output fits a particular purpose. We are not liable for lost profits, lost business opportunity or indirect damages. Output is produced automatically and may contain inaccuracies. Checking it before you publish is on you. Nothing in these terms limits liability that mandatory law does not allow to be limited, in particular for wilful misconduct, gross negligence, death or personal injury, nor the rights consumer law gives you. To the extent permitted by law, our total liability is capped at what you paid in the 12 months before the event that caused it.
Cover for misuse
If a third party claims against us because of content you uploaded or published, or because you used the Service in breach of these terms, you cover the costs that fall on us as a result, including reasonable defence costs. This does not apply where consumer law forbids it, nor where the liability is ours.
Suspension and termination
You can cancel your subscription at any time; it stays active until the end of the period already paid for. We may suspend or close an account for breach of these terms, payment fraud or abusive use, with prior notice whenever that is reasonably possible. After closure your content is deleted on the timelines in the Privacy policy. Unspent credits have no cash value and are extinguished when the account closes, without prejudice to the right of withdrawal and to any refund already owed.
Governing law and disputes
Brazilian law applies, being the law of the company’s seat. If you are a consumer habitually resident in the European Union, that choice does not deprive you of the protection of the mandatory rules of your country of residence, under article 6 of Regulation (EC) 593/2008 (Rome I). Portuguese Decree-Law 24/2014 and Decree-Law 84/2021 continue to apply if you live in Portugal. If you are a consumer in Brazil, the Consumer Defence Code applies and you may sue in the courts of your own domicile (article 101, I). For consumer disputes in the European Union you can turn to an alternative dispute resolution body: [ADR ENTITY], [ADR WEBSITE]. In Brazil the public consumidor.gov.br platform and the state Procon services are available. Where you are a consumer, the competent court is the one of your domicile.
General provisions
If a clause of these terms is invalid, the rest stay in force and the invalid clause is replaced by the legal rule closest to its effect. These terms, the Privacy policy, the Cookie policy and the Refund policy are the entire agreement between us regarding the Service, and replace earlier understandings. We are not liable for failure caused by events beyond our reasonable control, including network failures, power cuts, acts of authority or a prolonged outage at an essential vendor. You may not assign your position under this contract without our agreement. We may assign ours on a reorganisation or transfer of the business, without prejudice to your rights. Not exercising a right at a given moment is not a waiver of it.
Changes to these terms
We may change these terms. Material changes are announced by email or inside the application at least 30 days in advance. If you do not agree, you can cancel before the change takes effect.
